Yahoo teams up with Spotify for on-demand music

LOS ANGELES (AP) ? Yahoo is ditching its provider of on-demand music, Rhapsody, for a similar service provided by Swedish subscription-music service Spotify.

The changes to the Yahoo Music site are expected to be complete by early Wednesday. Spotify's rollout across the rest of Yahoo will take longer. Rhapsody had been a Yahoo partner since February 2008.

Yahoo visitors will soon be able to hit a play button and have songs play without leaving the website, while the previous incarnation required users to navigate away from the page, said Yahoo spokeswoman Lisa Goodwin.

Yahoo Inc. will also create an app for the Spotify platform that will provide original content like artist profiles.

Spotify is free on computers but users who pay $10 a month can choose songs for playback on mobile devices.

Investing Daily editor Jim Fink recently took a look at some of the top-performing stocks during the 2008/09 stock market crash and found AutoZone third on the list. While the rest of the market was in free-fall, the auto-parts chain soared 22%.

This Auto Repair Stock?s Selling More Car Parts Than Ever

More impressive is the stock?s performance since then: from March 9, 2009, to present, AutoZone has more than doubled, to its current level of around $377. But even with that big jump, it?s still reasonably priced compared to the competition, trading at 16.9 times its last 12 months of earnings.

Its profits, too, have remained impressive, rising 9.3% in the three months ended May 5, 2012, to $248.6 million from $227.4 million a year earlier. Earnings per share jumped 18.7%, to $6.28 from $5.29, on fewer shares outstanding. Sales were up 6.7%, to $2.11 billion. Domestic same-store sales (which exclude sales from new stores) rose 3.9%.?

Earnings were well ahead of the $6.23 a share that analysts were expecting, though sales fell just short of the forecast $2.13 billion.

Notably, sales of auto parts jumped 6.7%, to $2.07 billion. Profit margins edged up to 51.6% from 51.2%.

The company is pumping some of its rising profits into its ongoing expansion: in the latest quarter, its store count was up 3.8% from a year ago. It?s putting a good portion of the rest into its ongoing stock buyback program, which is helping boost its per-share profits even more. In the latest quarter, AutoZone spent $400 million to repurchase 1.1 million of its shares at an average price of $380 each.

This Toolmaker Has Carved Out a Unique Place Among Auto Repair Stocks

Snap-On (NYSE: SNA) is another company that?s benefiting from the rising age of North American cars.

The company?s main business is its Tools Group, which supplied 38% of its sales in the latest quarter. This business sells tools and services directly to auto mechanics through its 4,800 ?mobile stores,? or franchisee-owned trucks, that regularly visit mechanics at their places of work.

Snap-On?s ubiquitous tool trucks have helped it claim a large share of the North American tool market; by going directly to mechanics, the company is able to offer an unparalleled level of convenience and a hands-on way to assess its clients? needs. That?s something that?s tough for competitors who mainly sell through retailers, such as Stanley Black & Decker (NYSE: SWK), to match.

Broad-Based Business Sets Snap-On Apart From the Competition

Even though it?s mainly known for its tool trucks, Snap-On is much more than just a purveyor of wrenches and screwdrivers: it also supplies car-repair centers with computer diagnostic systems and repair information through its Repair Systems & Information Group (27% of sales), and serves other industries, such as aviation, agriculture and construction, through its Commercial & Industrial Group (35% of sales).

In the first quarter of 2012, the company?s overall sales rose 6% from a year ago, to $735.2 million. Earnings jumped 26.3%, to $71 million, or $1.21 a share, from $56 million, or $0.96 a share. Profits beat the Street?s forecast of $1.16 a share, while sales came in just under the $737 million that analysts were looking for.

Tool sales were a big part of Snap-On?s strong performance: in the quarter, auto mechanics bought $316.6 million of tools from the company, up 12.3% from a year ago. The Commercial & Industrial Group posted a 5.2% sales gain, while sales dipped 0.4% at the Repair Systems & Information Group.

The stock is more volatile than AutoZone, but it?s still up 17.6% so far this year. What?s more, Snap-On pays a regular dividend. Quarterly payments of $0.41 ($1.64 annually) yield 2.71%.

Tool demand will continue to rise with the age of the average North American car. That?s a long-term trend that should continue to push up Snap-On?s share price.

Egypt stirs Islamist joy, Gulf, Israeli doubts

LONDON (Reuters) - Egypt's new president may lack real foreign policy clout for now, but the mere fact that a Muslim Brotherhood man is at the helm of the biggest Arab nation will embolden fellow Islamists seeking revolutionary change around the Middle East.

Mohamed Mursi's tenure as head of state is likely to unsettle Israel, please the Jewish state's arch-foe Iran, and dismay secularist critics of the Brotherhood at home and abroad who argue that political Islam is no antidote to unemployment, a flatlining economy and social misery, analysts say.

It will also stir misgivings among some Gulf Arab states still struggling to respond effectively to the ousting of their long-term ally, deposed president Hosni Mubarak.

Analysts say any variations in aid flows from the Gulf may be an indicator of the health of their relationship with Cairo.

"Mursi's victory will not benefit us directly. But it is a symbol of a victorious revolution," Abu Yazen, an activist from the Syrian city of Hama, the repeated scene of bloodshed during Syria's 15-month-old uprising, told Reuters.

"Mursi and his victory illustrates that revolutionaries will not rest until they reap the rewards of their work," he added.

Mustapha el-Sayed, political science professor at Cairo University, said Mursi's victory in presidential elections confirmed a trend started in Tunisia "that the political force most likely to come to power in most Arab states after the fall of their regimes is the Islamists."

The Brotherhood, the world's oldest and most established contemporary Islamist movement, has wide influence in the Arab world even if, like in Egypt, its followers have often been repressed in Muslim-majority countries.

After wins by Islamists at legislative polls in Tunisia and Morocco, Mursi's election is prompting the world to think again about how it deals with advocates of Islamic rule.

But the Egyptian military is expected to keep a tight rein on foreign policy and will protect a peace treaty with Israel that brings in $1.3 billion of U.S. military aid a year.

As a result, the ability of the Mursi government to provide immediate material support to kindred political forces in other Arab countries may be limited.

COLDER PEACE WITH ISRAEL

And in any case, his urgent tasks will be at home, namely to bring Egyptians the stability and prosperity they are desperate for after stagnation and corruption under Mubarak, followed by 16 months of crisis.

But his focus on domestic affairs will not stop critics of the Brotherhood from looking on with trepidation.

Israeli officials have said they respect the election result and expect Cairo to continue to preserve the treaty. But Former Israeli Defence Minister Binyamin Ben-Eliezer said in an interview with Israel Radio that while the peace treaty would continue, it would be "much colder" in future.

"There's not a shadow of a doubt we have awoken to a new world, a different world, a world that is more religious, Islamist and anti-Israel. ... the man is known for his extremist views against the peace treaty with Israel," Ben-Eliezer said.

The Sunni Brotherhood, whose Palestinian offshoot Hamas rules the Gaza Strip, is strongly critical of Israel, which has watched the rise of Islamists in Egypt with growing concern.

Hamas hopes a Mursi presidency would loosen the economic shackles of a boycott of Gaza that Israel says is meant to stop the flow of arms to Gaza.

"The question is how Western states react, if they isolate Hamas further and keep trying to squeeze them out of power, then of course Hamas will turn to the Brotherhood for support, it is only logical," said Michael Stephens, researcher at the Royal United Services Institute based in Doha.

"They're a pragmatic party that takes help from anybody they can get."

Britain's Quilliam think tank said a topic to watch closely was increased rocket attacks from Sinai which "could destabilize the relationship between Egypt and Israel, particularly if Israel seek unilateral action inside Egyptian territory."

MURSI WIN LIKELY TO INFLUENCE LIBYA

In Libya it is still unclear how well the Muslim Brotherhood-linked party, the Justice and Construction Party, will do in Libya's first free elections slated for July 7 because the organization does not enjoy the same institutional popularity that it does in Tunisia or Egypt.

But experts and Libyan liberals alike believe that the Brotherhood win in Egypt will boost the confidence of their Libyan counterparts.

"The Brotherhood in Libya will see it not just as a victory for Egypt but a victory for the Brotherhood (generally)," said political scientist Omar Ashour.

He said if the Libyan Brotherhood were successful in Libya, an oil producer with big financial reserves, their Egyptian counterparts would look to them for contracts and opportunities to help the Egyptian economy through its struggles.

In Libya, secularists watch Mursi with some concern.

Watching a re-run of the Egyptian president's speech on a news channel this morning in his office, Mahmoud Jibril, Libya's wartime rebel prime minister who resigned last October told Reuters that Mursi's win in Egypt would "definitely" boost the Libyan branch of the Brotherhood.

"It makes our task here as democratic forces calling for a civil state and calling for equal rights for all Libyans, and calling for a real democratic process much harder," he said.

Gulf Arab states have reacted warily to Mursi's win.

Shadi Hamid of the Brookings Institution Doha branch said Mursi's win represented the first time an Islamist party had risen to the presidency in the Arab world.

"There is a symbolic power that is surely concerning to Gulf leaders especially those in Saudi and the Emirates because they are increasingly concerned about their own Islamist opposition."

GULF ARABS SEEN PREFERRING 'WEAK" EGYPT

Noman Benotman, a senior analyst at Quilliam, said Gulf states wanted the "weak Egypt" they were used to under Mubarak and did not want to regain the diplomatic weight it had in the 1950s and 1960s during the heyday of Arab nationalism.

"The Brotherhood is the group with the soft power and the influence to be able to revive Egypt and make it, once again, the most influential country in the Middle East," he said.

"Watch the economic cooperation with the Gulf. Will they fulfill the projects they have promised? I suspect not."

Hamid of Brooking said Gulf states would use economic clout to pressure the Brotherhood. "Egypt is going to need assistance - loans, foreign direct investment -- and the Gulf leaders, if they're smart, will use that to their own benefit," he said.

Emboldened by the growing clout of Islamists elsewhere, members of Islah, or Reform, in the United Arab Emirates have stepped up demands for greater power to go to a semi-elected advisory council.

"It's great, let the Islamists win, let them be demystified and show that they don't have a special warrant to create jobs, or resolve the Palestinian issue -- they are just regular guys," said Mishaal al-Gergawi, an Emirati political analyst.

"Jobs, the economy, society, identity -- all these issues that people are worried about in the Gulf, Islamists don't have an advantage in addressing these," he said.

Proposition 8 trial witness to stop opposing marriage for gay couples ...

David Blankenhorn, founder the Institute for American Values and a witness at the trial of the ballot which led to California?s gay marriage ban says he will no longer fight against marriage rights for gay couples.

Mr Blankenhorn wrote in an opinion piece for the New York Times that he still believed children had the right ?insofar as society makes it possible, to know and to be cared for by the two parents who brought them into this world?.

But, he said, ?there are more good things under heaven than these beliefs?.

Mr Blankenhorn cited firstly the ?equal dignity of homosexual love? and said that while gay and straight relationships were not the same, ?the time for denigrating or stigmatizing same-sex relationships is over?.

?Whatever one?s definition of marriage, legally recognizing gay and lesbian couples and their children is a victory for basic fairness.?

Secondly, he said ?mutual acceptance? and ?compromise? was a necessary part of living together in society, that ?bending the knee a bit, in the name of comity, is not always the same as weakness? and that he wanted ?conciliation?, not ?further fighting?.

Thirdly, Mr Blankenhorn said the emerging consensus among the broader general public had persuaded him in part to change his views.

The consensus, he said ?may be wrong on the merits?, but ?surely it matters?.

He wrote: ?I had hoped that the gay marriage debate would be mostly about marriage?s relationship to parenthood. [...]

?In the mind of today?s public, gay marriage is almost entirely about accepting lesbians and gay men as equal citizens. And to my deep regret, much of the opposition to gay marriage seems to stem, at least in part, from an underlying anti-gay animus. To me, a Southerner by birth whose formative moral experience was the civil rights movement, this fact is profoundly disturbing.?

He continued: ?With each passing year, we see higher and higher levels of unwed childbearing, nonmarital cohabitation and family fragmentation among heterosexuals. Perhaps some of this can be attributed to the reconceptualization of marriage as a private ordering that is so central to the idea of gay marriage. But either way, if fighting gay marriage was going to help marriage over all, I think we?d have seen some signs of it by now.?

Instead of campaigning against marriage for gay couples, Mr Blankhorn said he would ?like to help build new coalitions bringing together gays who want to strengthen marriage with straight people who want to do the same?.

?For example, once we accept gay marriage, might we also agree that marrying before having children is a vital cultural value that all of us should do more to embrace? Can we agree that, for all lovers who want their love to last, marriage is preferable to cohabitation?

?Can we discuss whether both gays and straight people should think twice before denying children born through artificial reproductive technology the right to know and be known by their biological parents??

Mr Blankenhorn had argued against gay marriage rights in the trial of Proposition 8 in 2010, characterising marriage more as a relationship in which to bring up children than a private relationship between two adults.

That court case ultimately ruled that Proposition 8, a public ballot through which voters revoked the rights of gay couples to marry in California, was unconstitutional. The court said his appearance constituted ?inadmissible opinion testimony that should be given essentially no weight?.

It said: ?Blankenhorn?s opinions are not supported by reliable evidence or methodology and Blankenhorn failed to consider evidence contrary to his view in presenting his testimony.?

Mr Blankenhorn?s Institute for American Values aims to ensure children grow up with both married parents, ?renew the ethic of thrift?, combat ?extremism in the Arab and Muslim world? and ?civilise? public conversation.

He has previously acknowledged benefits of marriage rights for gay couples. In his book the Future of Marriage, he said it would promote stable, committed relationships for gay couples, mean fewer children would grow up in institutions, reduce the incidence of hate crimes and drive progress in the American dream of equal opportunity regardless of an individual?s circumstances.

Human Rights Campaign President Chad Griffin told AP: ?While it can be difficult as a public figure to change course, I applaud him for taking a courageous and principled stand. His experience wrestling with the issue of marriage equality and coming out on the right side of history will be an inspiration to millions of fair-minded who are in the same?place.?

(AP) ? Not even R.A. Dickey's darting knuckleball could prevent another power show by the New York Yankees.

Robinson Cano hit a tiebreaking homer in the eighth inning, and the Yankees touched up Dickey for five runs in a 6-5 victory over the New York Mets on Sunday night.

Nick Swisher hit an early three-run shot against Dickey, who was coming off consecutive one-hitters ? making him the first major league pitcher in 24 years to accomplish that feat. But in a much-anticipated matchup at sold-out Citi Field, both he and Yankees ace CC Sabathia were missing their best stuff.

"We feel like we can beat everybody. We never go into a game saying, 'We'll probably lose this one because this guy's hot,'" Yankees slugger Mark Teixeira said. "When people say, 'You can't beat him,' we go, 'OK, we'll prove you wrong.' It's kind of fun."

Leading off the eighth, Cano drove a 2-0 delivery from Miguel Batista (1-2) over the home run apple in straightaway center for his 16th homer and fifth in seven games. Taking advantage of a shaky Mets bullpen again, the Yankees won the final two games of the weekend series by one run to finish 5-1 against their crosstown rivals this season.

"Not too bad for a bunch of chickens," said Swisher, eager to take a shot at Mets closer Frank Francisco.

Before the series, Francisco called the Yankees "chickens" and later explained what he meant was that they often complain about calls by the umpires ? especially balls and strikes.

Francisco saved the series opener Friday but was placed on the 15-day disabled list on Sunday with a strained muscle on his left side.

Including a sweep at home earlier this month, the Yankees have won five consecutive series against the Mets since May 2010.

The Bronx Bombers hit 15 home runs against the Mets this season ? seven at reconfigured Citi Field ? to account for 24 of their 32 runs. They lead the majors with 112 homers in 71 games, including 34 in the last 19 games.

"They hit balls out of the ballpark like there's nothing to it," said Mets manager Terry Collins, who acknowledged he should have brought in left-hander Tim Byrdak to face Cano.

The talk of the town lately, Dickey was riding an unprecedented roll of dominance that rivaled any in baseball history. But the knuckleballer had an uncharacteristic bout of wildness against the homer-happy Yankees and lasted only six innings. He walked three, hit a batter and threw his first wild pitch of the season.

"I didn't have a great knuckleball. It was just coming out wobbly a little bit. I kept searching for it," Dickey said.

Boone Logan (2-0) gave the Yankees another splendid performance out of the bullpen, and David Robertson retired Ruben Tejada with a runner on third to end the eighth. Rafael Soriano worked a scoreless ninth in the rain for his 15th save in 16 chances.

The Yankees have won 14 of their last 18 road games.

Sabathia, also coming off a complete game with double-digit strikeouts, gave up nine hits in 5 2-3 innings. He was betrayed by his defense while yielding five runs ? one earned.

"It's up to me to be able to pick these guys up," Sabathia said. "I didn't make good enough pitches with two strikes."

Dickey received a big ovation during pregame introductions and sent a smiling Alex Rodriguez sprawling to the dirt with a high-and-tight pitch in the first ? perhaps the first time he's been buzzed by a knuckleball.

Dickey used his bat and legs to help the scrappy Mets get started on their comeback from a four-run deficit. He singled off Sabathia in the fifth and hustled home from second on David Wright's two-out RBI single.

The 37-year-old pitcher slid into Chris Stewart at the plate, getting a face full of catcher's mitt as his helmet was knocked off and the ball squirted away.

Trailing 5-2 in the sixth, the Mets capitalized on Cano's error at second base to score three unearned runs with two outs. Vinny Rottino, pinch-hitting for Dickey, drew a four-pitch walk from Sabathia and screened Teixeira when Andres Torres grounded a two-run single just past the Gold Glove first baseman.

Tejada tied it with a single off Cory Wade, who struck out pinch-hitter Kirk Nieuwenhuis with the bases loaded to end the inning.

Dickey wriggled out of a bases-loaded, one-out jam in the second but couldn't escape in the third. Two walks sandwiched around Rodriguez's dribbler for an infield single loaded the bases for Teixeira, the pitcher's old buddy from their early days in Texas.

Teixeira made solid contact on a sacrifice fly, ending Dickey's streak without allowing an earned run at 44 2-3 innings ? second-best in team history behind Dwight Gooden's stretch of 49 innings in 1985.

Swisher then sent a 2-1 knuckler well beyond the 390-foot sign in right-center for his 11th homer and a 4-0 cushion. He clapped his hands high as he rounded first base and wore a broad smile when he got back to the dugout.

"Lucky," Swisher said. "I've never hit a ball like that off a knuckleballer, I know that."

It was the first home run off Dickey since Cincinnati slugger Joey Votto connected on May 17. After a no-decision in that game, Dickey won his next six starts heading into Sunday night.

"It didn't quite live up to the billing," he said. "But golly, I'm so proud of our guys who scrapped and fought. We can build off that."

Timothy Eden: Is Meditation Self-Indulgent?

"I just feel like there are so many problems out there in the world, me sitting in silence doesn't really do anything for them." Juan is a close friend and meditation student. His question rattled me. He continued, "It just feels too self-indulgent."

Many new meditators have the experience of questioning not just the utility of meditation but also the morality of it. But, is he right? Is meditation indulgent? Absolutely.

Meditation is complete indulgence in the experience of the present moment. We often think of indulgent behavior as being morally wrong, which it can be when it comes at the expense of a deeper connectedness.

We are sometimes taught to put the needs of others before the needs of ourselves -- even to our own detriment. Roshi Joan Halifax brilliantly refers to this as "pathological compassion." Health care workers are often described as having "compassion fatigue," a form of burnout that is widely discussed in more than 200 published papers. Interestingly, studies of compassion fatigue in health care workers show that it is associated with worse outcomes for their patients. Simply put, ignoring our own well-being in the face of stress can actually result in harm to others.

These findings are not just relevant to health care workers. Stress levels are extremely high throughout our country, especially in the midst of an economic crisis. Higher levels of stress have consistently demonstrated higher levels of chronic health problems, psychological illness, and violence.

As a means of dealing with stress, there are acceptable and unacceptable outlets. Escapism -- through alcohol, overeating, watching television, overworking, and legal or illegal medicating -- is seen as an acceptable, and paradoxically non-indulgent, outlet. Many patients appear for counseling after these methods have failed, or worse, done harm. Escapism does not address the root causes of stress; it gives temporary reprieve -- a quick stir of a boiling pot -- at the expense of deeper connectedness with self and others. And often, the very methods that we use to escape stress may cause further harm down the line.

Rather, acknowledging and being present with our stress through meditative practice is the best way of reducing it. By fully acknowledging our pain, we learn to be more authentic with ourselves and with others. Sitting quietly every day and focusing on the breath and the experience of oneself alone can be, as Jon Kabat-Zinn says, "a radical act of love."

Meditation is spiritual housekeeping. To meditate is to sweep the rooms of the stress of daily life. Would it be seen as overly self-indulgent to vacuum the living room before the arrival of a guest? The intimate silence afforded by meditation allows us to communicate with fewer interruptions from the mental static of stress.

What about the vast problems of the world, as Juan had asked? How does meditation help global starvation? Meditation doesn't purport to solve all the problems of the world, it simply focuses on developing a place of inner calm. But if 7 billion people found a place of inner calm, the world would know a greater peace.

Is meditation self-indulgent? Maybe selfless-indulgence might be a more accurate description.

California bullet train faces tough vote in Senate

Gov. Jerry Brown's request for $6 billion to start construction of the California bullet train will face a difficult vote in the Legislature in the coming days, prompting some last-minute political maneuvering that could significantly alter the structure of the project.

Brown is seeking approval of a long-standing plan to build 130 miles of rail in the Central Valley from Bakersfield to Madera, creating the backbone of a future rail network that would later connect with Los Angeles and San Francisco.

But the plan has met growing skepticism among some legislators who say it would put the bulk of the initial funding in a low-ridership area that would have little independent value until the full system is completed. An alternative is being crafted to change the geographic distribution of the funds.

The existing plan is expected to easily pass the Assembly when it is taken up this week or possibly next, but the Senate is a different matter. Brown needs 21 of the 25 majority Democrats in the Senate to get his funding, a high bar given growing criticism within his own party. No Republican is expected to vote for the project.

"It will be a tight vote," said Senate President Pro Tem Darrell Steinberg (D-Sacramento). "It's a tough vote. I can't predict the outcome, but I'm personally committed to it."

If he had his way, Steinberg said, he wouldn't start the project in the Central Valley either. Nonetheless, he's still a supporter of the plan. "There is greater risk in not moving forward," he said.

Steinberg said there are still discussions with colleagues on how to proceed, appearing to leave open some room for a compromise.

The skeptics in the Senate say privately that they are coming under enormous political pressure from organized labor, Rep. Nancy Pelosi (D-San Francisco) and the Obama administration, which plans to contribute $3.3 billion to the work. Whether they will fall in line with their party is unclear.

"The votes are not there," said Sen. Mark DeSaulnier (D-Concord), chairman of the Senate Transportation Committee. "I am a 'no' at this time."

"I don't think there are 21 votes in the Senate until people have a chance to examine their options," said Sen. Alan Lowenthal (D-Long Beach), chairman of a special committee on the high-speed rail project.

Sen. Joseph Simitian (D-Palo Alto), a third member who has closely studied the project, has not declared his opposition to Brown's plan, but he has said he shares the same concerns that Lowenthal and DeSaulnier have. Simitian is running for a county supervisor post that would require him to eventually give up his seat in the Legislature if elected, so he may be unencumbered in his decision.

In the backrooms of the Capitol, a Plan B is being created that would shift significant funding out of the Central Valley. For months, critics have questioned why the project is starting there. The answer has been that the Federal Railroad Administration wants it to start there and the U.S. Transportation Department has threatened to rescind the federal money if the state tries to upset the apple cart.

But a close examination of the grant agreements is leading state lawmakers to believe they are free to spend funding granted under the American Recovery and Reinvestment Act of 2009 anywhere within four segments of the project, including one between San Francisco and San Jose and another between Los Angeles and Anaheim. The only segment that would be built in the Central Valley would run from Madera to Fresno, accounting for roughly 26 miles of roadbed.

"A Plan B would be to invest where the riders are and where we will be able to attract private equity much sooner," DeSaulnier said.

Sen. Lou Correa (D-Santa Ana) also supports a new approach, saying, "My thoughts are very similar to Sen. DeSaulnier's. My priority is to create jobs here in Orange County and to invest tax dollars where we get the biggest bang for the buck. Anaheim-Los Angeles and San Francisco-San Jose are the places. If we don't focus on the L.A.-Anaheim corridor, there is no reason for me to go up on this vote."

It is unlikely that the Obama administration will readily go along. Organized labor doesn't like the idea either.

James Earp, a member of the California Transportation Commission and a labor leader who helped orchestrate the 2008 campaign for the state's high-speed rail bond measure, said he would oppose such a move because it could jeopardize federal support for the entire project.

On the flip side, however, are critics who say Brown's commitment to a now-unpopular bullet train project is jeopardizing his effort to persuade voters to approve a separate state tax increase this fall to help balance the state budget and fund schools.

Kris Vosburgh, executive director of the Howard Jarvis Taxpayers Assn., said he would use the bullet train project in the group's campaign against the tax increase.

"This is clearly a bad project," he said. "I am sure it will be mentioned in our campaign."

CAIRO (Reuters) - Egypt's anxious week of waiting for a president, a week marked by street protests and angry accusations between rivals of subverting the new democracy by force, is finally ending.

On Saturday, the electoral commission set 3 p.m. (2:00 p.m. British time) on Sunday as the moment it will announce either that yet another general will fill the post left vacant by last year's overthrow of Hosni Mubarak, or that the Muslim Brotherhood, for decades the army's bitter enemy, will finally hold the highest office.

For many, the latter is more likely. But nothing is certain.

The ruling military council, which pushed Mubarak aside to appease the Arab Spring protesters, has just stripped the post of many powers and dissolved the Brotherhood-led parliament elected in January. Yet the presidency is still a prize, even if the vote will not end the power struggles over Egypt's future.

An Islamist president of Egypt, the biggest Arab nation, would be a major milestone for the Middle East, near unthinkable 18 months ago. It is far from confirmed. But the military, Brotherhood and others gave signs of expecting it will happen.

Brotherhood supporters camped out in Cairo's Tahrir Square, where the revolution was won, were generally in festive mood, though fear of disappointment still nagged, after decades of rigged elections. In counterpoint, a few thousand rallied in a middle-class Cairo suburb to declare their support for the army.

The Brotherhood's candidate Mohamed Morsy, the 60-year-old, U.S.-educated engineer and political prisoner under Mubarak, had declared victory within hours of polls closing last Sunday - a move condemned by the generals. He has already met other groups and drafted an accord to form a national coalition government.

His party issued a statement on Saturday saying it had called on "all partners in the nation, from all movements, to take part in this national platform, to guarantee the success of what we have achieved and their active participation in rebuilding the country in the manner it deserves".

One of those involved in the talks, Abdel Gelil Mostafa of the reformist National Association for Change, told Reuters: "We agreed on a general programme, especially for if Morsy won.

BROTHERHOOD, ARMY TALKS

By contrast supporters of former air force commander Ahmed Shafik, 70, who was Mubarak's last prime minister, kept a low profile, although Shafik said on Thursday has confident.

The Brotherhood has said it will go on protesting until the military council cancels the dissolution and a decree which gave its legislative powers to itself, the Supreme Council of the Armed Forces (SCAF). But were its candidate to be confirmed in office, then the wary symbiosis between the two old enemies, seen since Mubarak was ousted, may continue in a new form.

It is a collaboration that irks many of the secular liberals who led the first wave of the uprising against Mubarak but found themselves fragmented and eliminated in last month's first round of voting, left with a difficult choice between army and Islam.

MILITARY ROLE

Impatient Brotherhood supporters have been out on Tahrir Square day and night since midweek. Thousands were there again on Saturday, chanting "Victory for Morsy!" and "Morsy, Morsy, Allahu akbar!" (God is greatest), while waving national flags.

"We want the military council to announce the real results without forgery," said Hassan Eissa, 43, an accountant from north of Cairo who was demonstrating on the square.

"They have no right," Eissa said. "Egyptians shouldn't be under any kind of guardianship after the revolution."

A few thousand people also gathered with flags in the suburb of Nasr City to praise the army, the institution has run Egypt, amassing wealth and privilege along the way for its upper ranks, since the "Free Officers" toppled King Farouk in 1952.

"We came here to tell all the people that we are standing by our army," one demonstrator told state-owned television channel Nile News. "Our army is the line that cannot be crossed, the red line which we will let no one touch."

While they have said that inaugurating the new president by July 1 will meet the deadline they set themselves for civilian rule, their moves in the past 10 days to curb the presidency and hang on to a veto over legislation, as well as to claim a role in drafting a new constitution, mean that the process goes on.

Washington and the European Union, both major aid donors, have expressed concern that the military is backtracking. But both also share its anxiety over a sweeping Islamist takeover, worried about Egypt turning anti-Western and reneging on its peace with Israel, and also voicing concern for civil rights.

Key to the transition to democracy will be drafting a constitution. Some supporters cite the example of Turkey as a model - a Muslim democracy with a history of military interference in politics, where devout, elected politicians have slowly asserted control.

The bearded, bespectacled Morsy was not a familiar figure to Egyptians. Some ridicule him as the movement's "spare tyre"; his campaign began after a more senior leader was barred from the race. Oilers take Russian F Yakupov with NHL's top pick

PITTSBURGH (AP) ? The Edmonton Oilers are getting tired of going first in the NHL draft and Nail Yakupov knows part of his job is to make sure it doesn't happen again.

Edmonton, picking No. 1 for the third straight year, grabbed the speedy Russian forward with the top pick on Friday. The Oilers believe the dazzling 18-year-old can join Taylor Hall and Ryan Nugent-Hopkins ? the No. 1 picks the previous two years ? in returning the once proud franchise to relevance.

Yakupov certainly thinks they can.

"I think it's going to be a great team," he said after becoming the first Russian taken No. 1 since Washington selected Alex Ovechkin in 2004.

Hall, Nugent-Hopkins and Yakupov give the Oilers the kind of core to build around, but even as they celebrated Yakupov's rise, they caught a glimpse of how nothing lasts forever in the NHL.

Barely an hour after Yakupov donned his blue Edmonton sweater, the draft host Pittsburgh Penguins shook up the proceedings by sending center Jordan Staal to Carolina ? reuniting him with older brother Eric ? for center Brandon Sutter, defenseman Brian Dumoulin and a first-round pick they used to select defenseman Derrick Pouliot.

The 23-year-old Staal, along with Sidney Crosby and Evgeni Malkin, provided the backbone that turned the Penguins into perennial Stanley Cup contenders. Now he's heading south after declining a contract extension.

"We wanted a deal (with Staal)," Pittsburgh general manager Ray Shero said. "But it was obvious in the last 24 hours that ... this was the right thing to do."

The Penguins weren't done, trading defenseman Zbynek Michalek to Phoenix for two players and a third-round pick just after the end of the first round.

The draft continues Saturday, with more fireworks expected.

Yakupov and Staal provided enough on Friday night.

The charismatic Yakupov models his game after former NHL star Pavel Bure, and in a way the youngster already has a leg up on the Russian Rocket. Bure scored 437 goals during his 12-year career, but he wasn't taken until the sixth round of the 1989 draft.

Yakupov, who spent the last two seasons with the Sarnia Sting of the Ontario Hockey League, didn't have to wait nearly as long to hear his name called. The Oilers practically sprinted to the podium to grab a player they believe has plenty of potential.

Yakupov, who scored 31 goals in 42 games last season, is eager for the next step following weeks of speculation.

"It's not over, it's just starting," he said.

Born in the Republic of Tatarstan in Russia, Yakupov has consistently shot down speculation he is going to return to his homeland and play in the Kontinental Hockey League. He stressed repeatedly in the days leading up to the draft that the NHL is "the best league in the world."

While hardly the biggest player on the ice, the 5-foot-11, 185-pound Yakupov has dazzling speed and nimble footwork. He plays with a relentlessness that made him the top player on most draft boards. Yakupov broke Sarnia's rookie scoring record ? previously held by Steven Stamkos ? in the 2010-11 season when he finished with 49 goals and 101 points.

Yakupov was also a rarity in a top 10 dominated by defense. Other than Sarnia teammate Alex Galchenyuk, who was taken third overall by Montreal, the other eight picks were defensemen.

The Columbus Blue Jackets continued to shore up their blue line by taking Ryan Murray of the Western Hockey League's Everett Silvertips with the second pick. The 6-foot, 198-pound Murray had nine goals and 22 assists in 46 games last season.

The 18-year-old became the youngest player since Paul Kariya in 1993 to play for Team Canada in the world championships this spring, and his ability to make an impact on both ends of the ice won over the rebuilding Blue Jackets.

"We are very happy to have Ryan Murray join our organization," general manager Scott Howson said. "He solidifies what we believe is a position of strength. His character and two-way play will be very valuable to our hockey club."

The prideful Canadiens, coming off a miserable season, hope Galchenyuk can one day provide a needed spark to a lethargic offense. The talented center missed all but two games of this past season after he tore a knee ligament.

Galchenyuk, born in the U.S. to Russian parents, is considered a gifted passer. He totaled 31 goals and 52 assists during the 2010-11 season. He already speaks two languages, and joked that he had better start picking up French.

"I think I have classes starting next week," he said with a laugh.

With the top high-flying forwards off the board, teams then went heavy on defense in a draft considered short on offensive star power.

The New York Islanders chose defenseman Griffin Reinhart with the fourth pick, starting a run of seven straight defensemen taken.

Among them was Derrick Pouliot, taken eighth overall. That Pouliot was taken so high wasn't remarkable, it was the team that got the pick to grab him that shook up the night.

The Hurricanes had the eighth selection but things changed quickly when NHL commissioner Gary Bettman walked onto the stage and announced a trade the hometown crowd "might want to hear."

Moments later, Pouliot pulled on a black Pittsburgh jersey.

"Yeah, I was a little surprised," Pouliot said.

Washington ended the run on defensemen, taking center Filip Forsberg with the No. 11 pick. The 17-year-old Forsberg was the youngest player on Team Sweden at the 2012 World Junior championships. Forsberg said he models his game after former NHL star Peter Forsberg, though the two aren't related.

The Buffalo Sabres took center Mikhail Grigorenko, who like Yakupov is from Russia, with the No. 12 selection. The massive 6-foot-3, 200-pound Grigorenko led rookies in the Quebec Major Junior Hockey League in scoring last season, netting 40 goals and adding 45 assists for the Quebec Remparts.

The Staals weren't the only players who made the draft a family affair. The Boston Bruins chose goalie Malcolm Subban with the No. 24 pick. Subban's older brother, P.K., is a forward with the Canadians.

Phoenix drafted forward Henrik Samuelsson at No. 27. Samuelsson's father, Ulf, played 1,080 games in the NHL and won two Stanley Cup titles with Pittsburgh.

The elder Samuelsson received a warm ovation when his face flashed up on the Jumbotron. It likely won't be the same for former NHL player Stephane Matteau, whose son Stefan was taken by the New Jersey Devils with the 29th pick.

Stephane Matteau, playing for the New York Rangers, eliminated the Devils and rookie goalie Martin Brodeur with a double-overtime goal in Game 7 of the Eastern Conference finals in 1994.
